ANTI-FASCISM POEM: In Efface of Creeping Fascism

He was a custom
Too accept
That creep
Creep
Creep
Of fascism
Without a furor
Incite
Picking wons
Fights
Posedly agin
And agin
Sow frayed
Peering opposed
Laws and orders
As just
Be for
It’s too late
Over
Due
In efface of populations abashed
In habiting legions of apprehensions
With all
Act right
A weigh
Even as if
Unhinging
On won soul

got fascism? POLITICAL BUTTONThis anti-fascism poem was inspired by some recent situations in my life and my reflection on the endemic response of many to use the rubric of “picking one’s fights” to avoid pushing back against creeping fascism.  My most recent experience with creeping fascism was on a long bus trip when a U.S. Border Patrol agent boarded the bus during a layover at a station in the middle of the night.  The agent asked some riders “Do you mind telling me your country of origin?”  First, this was odd because we were in Rochester, New York, several hours from the Canadian border (a known backdoor for alien entry); and the bus had been in the Buffalo station, which is much closer to the Canadian border.  I Don't Agree With President Vader's Policies, But I Still Think We Should Support Our Storm Troopers POLITICAL BUTTONThe Border Patrol agent was profiling passengers and he never asked me, a white guy, anything.  The agent also did not ask for identification or “papers,” so he was not very rigorous in this fishing expedition.  Perhaps this was a tip of the hat to the honest-faced people he was profiling, but I strongly suspect that the primary purpose was actually to make people afraid rather than nab aliens or criminals.  QUESTION AUTHORITY Before It Questions You POLITICAL BUTTONAs this agent was questioning passengers, I was pondering what to say if he asked me the loaded question: “Do you mind telling me your country of origin?”  Of course, I minded.  Refusing to answer the question was my first preference.  I could answer honestly, that I was born in Haiti.  Perhaps I could reveal to him that I am a convicted felon.  Maybe I could let him know that I detest creeping fascists.  But, alas, I didn’t fit his middle-of-the-night profile.  Perhaps us hippies are going to have to work harder to make the list.

A Nation of Sheep Soon Beget a Government of Wolves - Edward R. Murrow Quote - POLITICAL BUTTONI was somewhat surprised and very much creeped out by this incident, but it has increased my resolve to push back against creeping fascism at every opportunity.  As luck would have it, I arrived back in Toledo early morning Tuesday, in time for our weekly Trump Tuesday protest outside Sen. Rob Portman’s office and his aid happened to be available that day to speak with a group of us.  So, I was able to share this story of the Border Patrol agent on the bus.  Plus, us Trump Tuesday protesters had been experiencing ongoing creeping fascism in the form of building security arbitrarily limiting only four of us in the lobby at any one time to fill out comment sheets for Sen. Portman.  While there was an alleged policy regarding this, I suspect it never existed, nor could it hold up to constitutional muster.  One Nation Under Surveillance POLITICAL BUTTONThis alleged policy apparently applied to an identifiable group of people peaceably assembling, not, for instance to a dozen apparently random people in the lobby.  The lobby security guard didn’t like us, and he spoke demeaningly, especially to the women protesters.  Most of the protesters complied with this arbitrary restriction by herding only four people at a time into the lobby.  However, I made a point of filling out a comment sheet only if I could be a fifth person.  I never got any hassle for doing this, but if I had, I would of insisted on seeing a written policy.  For whatever reason, there was a new security guard in the lobby.  The new security guard didn’t care how many of us came into the lobby.  As five of us entered, I declared the new reality, “We now have 25% more democracy!”

Police Everywhere, Justice Nowhere POLITICAL BUTTONBeside directly oppressing target groups, creeping fascism has the nefarious side benefit of training others to tolerate little creeps of fascism that may seem uncivil to resist.  I find this a good example of how our quest for propriety can interfere with simple, and small, moral actions.  Perhaps ironically, resisting these little creeps may bring about disproportionately large consequences.  I contend that this disproportionality is the best evidence for an unjust situation and social control through intimidation.  Unfortunately, the risk of disproportional consequences is the very reason that people often cite for not resisting, and in solemn pronouncements of practicality state, “You have to pick your battles.”  Of course, you do.  Though I prefer to call them opportunities.

POEM: Cruel After Math — Owed to Sen. Rob Portman’s Health Care Vote

What kind?
Of cruel after-math
Is Sen. Portman working up
The American people
Facing death
Bye the tens of thousands
Buy the tens of billions
For tax cuts
For the richest Americans
For loaded corporations drunk on power
What is owed
To the flush and the flushed
To the affluent and the effluent
How does this add up?
What is the take away?
Is this the American will?
The right to health care
Or merely the extreme right of congress
Into an afterlife
Leaving loved wons behind
And nothing else
A cruel after-math
It’s your cull
A nation divided
Halves and halve nots
And what might
You be culpable of
Americans may ever no
Of a partisan’s last will and testament
Sow telling
In the ends
And the means
Of congress
And its reverse
Progress

This is the poem that I read at today’s health care protest outside of Sen. Rob.Portman’s Toledo office (see video of poetry reading).  A large laminated version of the above poem was delivered to his office.  There were an estimated 45-45,000 protesters.  In the photo below, I am pictured in the center next to “Flat Rob,” a cutout of Sen. Portman that we use to conduct our own town hall meetings on the street, since Sen. Portman does not see it fit to hold official town hall meetings with his constituents.

PROTEST POEM: Round The Public Square

Theirs
Smoked filled plays
Behind closed doors
Where there is no room
In the halls of power
Fore the wrest of us
Relegated to copping democracy
Round the public square

This protest poem deals with the reality that lack of transparency and accountability in government obliges citizens to apply political pressure through protests, demonstrations, and nonviolent civil disobedience.  Those who profess to favor freedom, and yet deprecate agitation, are men who want crops without plowing up the ground. Frederick Douglass quote POLITICAL BUTTONSometimes justice demands circling city hall and other halls of power for around whole to fit in a public square.  I am particularly proud of the “copping democracy” phrase subject to double meaning.  Law enforcement is often poorly trained and cops bad attitudes toward nonviolent citizens exercising their first amendment rights and petitioning for redress of grievances.  Protest beyond the law is not departure from democracy; it is essential to it -- Howard Zinn quote POLITICAL BUTTONJudges and courts are often poorly equipped and acculturated to treating nonviolent protesters as more than common criminals.  Our criminal justice system exacts a disproportionately high cost upon conscientious citizen protesters actively working to right wrongs in our government and communities.  This disproportionately high cost on highly politically engaged activists stymies the vitality of our democracy and reinforces systemic injustices.  May we learn to value the vital role protest and resistance play in actualizing a vital democracy.

Toledo LOVE Fest: Anti-Trump Rally

As Donald Trump brought to Toledo his caravan of hate, bigotry and xenophobia, Toledoans met him with a LOVE fest, declaring resoundingly that his fear mongering is not welcome in Toledo.  Here is my favorite picture from the rally:

Top Pun Loves Muslims, Welcomes Immigrants, and Works to End Racism

Earlier, I met these two women while they were circling the block in their car.  I witnessed them being harassed by a cop for reportedly not turning immediately on a green light and holding up traffic. Ironically, the biggest lineup of cars that I saw at the corner were produced by the cop stopping them for a couple minutes. Not pictured is a sticker on my back that says, “I LOVE MUSLIMS.”

I LOVE MUSLIMS

We had someone else take a similar picture of us with one of the women’s phones (you can see this on the left of this pic).  I asked if they could share the pic with me on facebook.  They responded that they don’t do social media.  They prefer to keep it simple and real.  I LOVE THIS!  This is WAY better than getting a copy of their pic.  And, as it turns out, the love karma and sharing mojo, sent this picture my way anyways.

In unrelated karma, the police were out in force, the only ones dressed for a riot.  I couldn’t help but notice that the vast majority of the police for the vast majority of the time were facing the LOVE fest participants, not the Trump designated side of the street.  Hmmm…who do the police think are the threat, and whom are they focused on protecting?

Police Lineup

I was instructed by two separate police officers at two different times to return to the other side of the street, the protesters’ side.  There were plenty of legal observers (lawyers) present.  I spoke with several of them.  They confirmed that it is illegal, an unconstitutional limit of free speech and peaceable assembly, to partition public spaces into partisan zones.  In years past, the police set up “free speech zones” (sic), areas cordoned off with police tape to box up and control protesters.  Such “free speech zones” have  been ruled unconstitutional.  The legal observers are making a report, and, hopefully, this experience will add to the training of law enforcement officers as to their legitimate, legal duties.

Thanks to a grant from Homeland Security (emblazoned on the side of the armored vehicle), a military-style armored truck was parked adjacent to the demonstration area.  This was accompanied by a set of more-heavily-equipped police officers ready to leap into action if there was some type of invasion that a couple dozen policemen (there were no women cops) couldn’t handle.  This all strikes me as a great opportunity to normalize the militarization of local police forces.  Would we call a nation patrolled with armored trucks the “land of the free?”

Military-style police armored truck

If you would like to see more photos from Toledo’s LOVE fest and anti-Trump rally, check this out.  There were plenty of beautiful Toledoans and wonderful signs of love and anti-Trump messages.  May peace and love break out everywhere!

POEM: What Sup? — Owed to Michael Brown and Ferguson, MO

They come with walls of armor
And arms, oh, the arms
Ever prepared to do the riot thing
Will their fear be matched
By the fire in the bellies
Of protesters
Waving conflagrations
Or hands bound
Staring down such a dear accost
As inevitably meet
Each hankering in their own weigh
For just another
Setting at the table
Inescapably found
In the porous of communities
When poach talk
Left behind
In an escaping domesticity
Beyond bred and whine
And parting shots
Dis tending question
What sup?

This one goes out to all of those in Ferguson, Missouri, dealing with the aftermath of the murder of Michael Brown by a police officer — yet another young black male killed without justification by a white police officer in America.  Michael Brown is dead and racism is alive and well in America.  Much of white America is apparently puzzled by the outrage, focusing on how they can protect themselves from the rage of their victims.  The cries for security, meaning white security, overshadow the cries for justice.

This poem reflects on the militarization of law and order, which is more consistent with the crime committed by a law enforcement officer than protecting and serving the community where that crime was committed.  You just have to look at who is dressing for a riot.  Hint: it’s not the masses of peaceful demonstrators.

The main images used in this poem center around the home as the foundation of community.  The porch and the dining rooms where lives are shared and bread is broken is a glue that holds together community.  Still, when it is not safe to walk the streets, porch talk and a good meal are not enough.  There is a time to take to the streets and reclaim one’s community.  The good people of Ferguson and America deserve an answer to the question, “What sup?”

POEM: Fermi Too

From Detroit to Toledo
I drive by and by
Monroe’s Fermi 2
Nuclear waste tower
Falling over
Penning only
A plume of death
In place of this poet
A prophet taking
Having called for its decommissioning
Offers no comfort
Only one more thing to mourn
Sanity unheeded
As the tsunami of insanity
Overtakes us
A graveyard of scant profits
Where we stood
Where we lived
And worked
No re-creation
As even the god of destruction
And his unwitting fallowers
Dare not rejoice

Today is the three-year anniversary of the Fukushima nuclear power plant ongoing disaster.  I joined some folks outside the Japanese consulate in Detroit.  The Japanese consulate and security would not let us in the renaissance center where the consulate is located.  We wanted to deliver a letter mourning the loss of life due to the Fukushima meltdowns, and deliver a call to remediate additional harms as this disaster continues to unfold.  We protested outside and read the letter publicly.  There were as many police and private security personnel as their were protesters, so no one was harmed in the protesting of this mega-disaster.  If only such well-resourced public safety extended to nuclear power plants.

I wrote this poem a couple of months ago, spurred on by driving past the Fermi 2 nuclear reactor in Monroe, MI, on my way to Toledo from Detroit.  I’ve driven through this nuclear kill zone many times, and I live most of my life in the kill zone.  The Fermi 2 nuclear reactor site has an overfilled high-level radioactive waste storage building, five stories tall, that cannot be off-loaded because it was not built to its design specs — oops.  If this tower falls, the death toll would be unfathomable.   There is no permanent solution to radioactive waste here or anywhere, which has been building up over 60 years of commercial nuclear reactor operations in the United States.  Making matters worse, there is a proposed Fermi 3 nuclear power plant, a $15 billion monstrosity as an answer to declining electricity usage in the region.  We need to end nuclear power before nuclear power ends us.

Romney Campaign Bans Top Pun from Event

Today, the Mitt Romney campaign held a “victory” rally at the Seagate center in downtown Toledo, Ohio.  Top Pun ran into a mitt-full of cards as the Romney campaign drew a full house; but, as the rain fell, Top Pun declared victory is he drew a royal flush from the Romney campaign, being banned from the event even though possessing a ticket and a media pass.  As the rain fell, Romney supporters lined up two by two around their concrete ark, hoping to save themselves from extinction.  As the Romney-ites waded patiently to see their would-be monarch, I could tell by the many white faces that this wasn’t the servants entrance!  Of course, there were many tanned Romney-ites, but most seem to have vacationed South, or had a tad freaky spray-on or tanning booth tan — perhaps emulating their feckless leader.  Even given the many wet backs that were present, few would be mistaken for Latino.  The only African-Americans I saw near the Romney lineup were button and T-shirt vendors.

Of course, across the street, there was an anti-Romney protest that was much more colorful!  One protester even wrapped themselves in the flag, a gay pride flag, that is.  Not wishing to be restrained by the designated “free speech zone,” I protested outside the box.  I took the opportunity to walk back and forth on the sidewalk alongside the Romney lineup (with few unusual suspects), of course, with my signs:

The Romney crowd, perhaps not so surprisingly, responded with vitriol.  At one point I chanted, “Can someone give me a nice hello, and end of this ugly vitriol.”  One woman asked me if I even knew what a blind trust was.  I trust that she did.  Many in the Romney lineup told me to go to the other side of the street; I suppose in some attempt to keep like with like, and perhaps, hate with hate?!  As I walked up and down the so-called Romney side of the street, even a sheriff’s deputy told me to get on the other side of the street.  When I told him that I knew my rights, and that walking down the public sidewalk and not blocking the public sidewalk was simply exercising my free speech, the sheriff deputy responded: “Would you be walking along here if this were an Obama event?”  I told him that if this Romney event were not happening, that I would have been in Bowling Green protesting the Obama campaign event (likely with a drone and anti-war message).  He told me again that I could not be on the side of the street.  When I persisted in claiming my first amendment free speech right to be there, he said that I was becoming disorderly.  I turned and walked the other way, continuing to walk back and forth, but keeping an eye out for him and his comrades.  The saddest part of this encounter is that the sheriff deputy was apparently proscribing a particular type of free speech — like free speech depends on whether you support Romney, Obama, another, or nobody at all!

The most popular response from the Romney crowd was: “Get a job,” often with some ‘hippie’ or ‘cut-your-hair’ comment thrown in for good measure.  Occasionally, I responded with “I have a job; in fact, I am self-employed, I created my own job.”  Sometimes I might throw in “I even left a government job,” but nary a poker face yielded any approval.  Once, when a Romney-ite was particularly uncivil to me, and I requested that we at least be civil, a woman in the crowd showed approval.  I did experience two Romney-ites threatening violence.  The first was when I overheard a man say to the crowd, “Do you want me to beat up the hippie?”  I asked him if he was threatening violence to me and he said, “It’s an offer.”  The other person, a man, or perhaps man-wannabe, said “I’ll beat your face in.”  I asked him if he was threatening violence to me and he said, “Yes.”  I asked him if he’d like me to call law enforcement over and he said, “Yes.”  Well, his bully talk didn’t faze my walk.  Just goes to show, you can usually rely on the general cowardice of humankind (human-unkind?).

On this rainy day, God rained on the just and the unjust.  Most of the Romney-ites hugged the publicly financed Seagate center rationally seeking shelter so as to not tax their dry wits.  And, since the first shall be last and the last shall be first, I joined the Romney-ites, the end of a long line.  I had secured online the night before my ticket to the event   Being practically soaked to the bone, having paid my dews in the open streets, the ink was running on the ticket that I had printed out and the scanner failed to read it.  I was told to wait for a higher power.  What more irony could I ask for then cryptic ink running on a ruinous ticket.  Of course, not relying on serendipitous irony, I had brought a brown manila envelope containing my tax returns for the last 10 years (actually, which are heavily redacted blank sheets of paper).  Knowing that airport-like security was to be the order of the day, security personnel would likely ask me to open this envelope.  Then, I would respond that I was hoping that if I gave Mitt my tax returns then maybe he would give me his.  I knew that this would probably not be satisfactory, and my alleged tax returns would be declared a security threat and the irony would be complete!  In the meantime, while I was waiting for a boss-man’s stamp of approval for entrance, the young man with a scanner, the first line of security, saw that I had registered by name as “Top Pun,” and he asked me for some ID.  I showed him my media pass (shown below) and my driver’s license.  I told him that I was the soul proprietor of the business, that I wrote a blog, and that I was going to report on this event.  He asked me what kind of business it was.  I told him that I make things like buttons and T-shirts, pointing to my mission statement emblazoned on the media pass and business card, “Maximizing Prophets.”  He didn’t seem to have anything to say to this.  Just then, a man came out and said that the doors would be closed and locked, so if you wanted to get in, get in now.  The young man with a scanner tried to scan my ticket again and it worked!  I went through the two sets of doors and got in a short line for their main security check.  However, as I waited in the security line, another man told the dozen or so of us waiting at security that the fire marshal said they were full and we had to leave.  We went outside.  After a little while, someone came back out and said that we could go in again.  Again, I got in the security line.  Just as I had emptied my pockets and the woman at security asked about the brown manila envelope, a sheriff deputy called me back through the set of doors.  The sheriff deputy instructed me that the event organizers would not let me in their event.  There it was: I was officially uninvited from the Romney victory rally.  Be the change you want to see in the world.  Now, if we could only all get uninvited from a Romney victory rally…

POLITICAL CARTOON: General Jesus Welcomes NATO Protesters to Chicago

Jesus Welcomes NATO Protesters to Chicago!

Jesus Cartoon: General Jesus - Protesting NATO in Chicago

Jesus and I will be at the NATO protest this Sunday in Chicago.  The temperature is expected to be 87°.  The Chicago Centurions, i.e., the Secret Service and the FBI, will not be allowing more than 3 ounces of liquid per protester in the designated demonstration locations.  Also, the powers that be will not be allowing protesters to bring any food with them.  This is a great way to kill off protesters with heatstroke!  However, this is probably merely a cynical way to assure that food and beverage vendors make a killing.  Wow, you’ve got to love capitalism!  Fortunately, with Jesus there, the protest is likely to be very peaceful; since the protesters will have no more than 3 ounces of wine to drink!  Yes, it should be a sobering experience — hopefully a for all concerned, and those not so concerned.

So, until next Sunday, with the next edition of General Jesus, Comedian Jesus, Doctor Jesus, CEO Jesus, Country Club Jesus, etc., let me know what you think.

This design goes out to all those Occupy Wall Street protesters everywhere!  I like this cool design because of the obvious incongruity of juxtaposing supporting the police and beating oneself up.  While the police are part of the 99%, they are also tools for the 1% to enforce, typically selectively enforce, laws that will protect the power of the 1%.  Dealing with nonviolent protesters is not something for which the police are typically well-trained. Police routinely rely on militaristic methods for crowd control and social control.  Police brutality and abuse is a natural outgrowth of this approach.  Presumptively having the law on their side, as the enforcers of laws, police can shield themselves from accountability and overreact to peaceful demonstrators.  Fortunately, one of the purposes of nonviolent demonstrators is to expose the inherent violence in the system, and the front lines of this is often law enforcement and the military.  Of course, when police overreact and use violence to quell peaceful demonstrations, denial of doing anything wrong, a refusal to be accountable for one’s actions is typically the first response.  This only highlights the gap between the immense responsibility that police have to behave well and the reality that the socially sanctioned possessors of violence can get away with violence much easier.  Suggesting that a protester beat themselves up preemptively is a way to highlight the farcical notion of the purity of law enforcement and violence to control other people.  Rather than law enforcement officers receiving harsher punishments for “unnecessary” violence, it is rare to see police prosecuted successfully for such misbehavior.  Maybe we should expect that such misbehaving police should regulate themselves, and that they should beat themselves up!

Kent State Massacre POEM

Today is the 42nd anniversary of the Kent State Massacre, where four students were killed and nine students were injured when National Guard troops opened fire on anti-war demonstrators.  Below is a picture of Arlington Midwest at Kent State, May 4, 2006.  Arlington Midwest is a display of the Northwest Ohio Peace Coalition which organizes traveling displays of tombstones representing the human cost of the war in Iraq and Afghanistan.  The display includes a simulated tombstone with name, rank, age and state of origin for each fallen U.S. soldier.

Kent State 1

Below is a  poem reflecting on the Kent State Massacre, by Terry Lodge, a member of the Northwest Ohio Peace Coalition, activist lawyer, Toledo’s People’s Attorney, and usual suspect:

Looking down from the black marble memorial
Grave reminder
Of a dark chapter
A nonfiction nightmare
Played out in an Ohio theater of war
I’m halfway between Blanket Hill and the valley of death of May 4, 1970
An observation post above a field of green
Today dressed up as thousands of war crimes.

It is May
And the semi-shade of the black oak branches
And their celadon new leaves
Wreath the distant, orderly rows
Of white spring petals
Fallen from the Tree of Life.

Tears water this chiaroscuro of whitewash, nestled
In the shadows where crimes against humanity are plotted.
From a distance, it’s a palette worthy of Manet,
Choreographed by Rumsfeld.

These petals will produce no fruit
Nor beauty or poetry
Their leaves are pages of the guest registers
Of three thousand funeral homes.

Silently we listen
For some hopeful spring noise
That their blood might have nurtured,
Answered by silence.

DTE Shareholder Protest

Between 200 and 200,000 protesters gathered outside the DTE Energy headquarters in Detroit, Michigan.   This DTE Energy protest  was visited upon by two to 2,000 Occupy Toledo protesters.  One unidentified protester, with a striking resemblance to Homer Simpson, wearing a notorious rainbow colored peace hand designed by Top Pun, showed his anti-nuke colors.anti-nuke Homer SimpsonAnother Occupy Toledo protester was less well disguised.  Michael Leonardi, pictured below, to the left, of course, can be seen waving his Occupy Toledo colors and anti-nuclear banner.  Mr. Leonardi received some criticism from other protesters for leading the way, since the more numerous yet bland protesters may have missed their photo op.  Mr. Leonardi bore this burden of leadership well and led despite his numerous followers.Detroit Edison Shareholder ProtestAs Mr. Leonardi and the other alleged participant, a.k.a. Top Pun, came to this protest they made the obvious mistake of parking in the casino parking garage.  The collusion of the purveyors of our casino economy had rolled out the concrete carpet that was a largely empty casino parking garage.  This free parking was apparently not to be had by mere commoners or the general public.  When we were spotted walking out of the parking garage with our fluorescent yellow Occupy Toledo signs and in our radiation suits, the very astute security recognized that maybe we weren’t there to gamble away our hard earned dollars.  This special DTE Energy shareholder security made it clear that we were not welcome and told us that if we didn’t move the car that they would tow it.  They were even kind enough to follow us out (pictured below) to make sure that no empty parking spots were harmed in the making of this fiasco.  Hear, hear, the last thing any anti-nuclear protesters want to do is have anybody take any unwarranted risks, like, say, storing 550 tons of nuclear waste in a five-story building that can’t be offloaded as built without knocking the building over.

Julia Bates Retirement Party, Mock Award

Today a few dozen people descended upon the Lucas County Courthouse in downtown Toledo, Ohio, to wish Lucas County Persecutor Julia Bates a happy retirement and demand justice for Danny Brown

Occupy Toledo had a cake, party hats, noisemakers, and a card to sign.  Several persons went into the courthouse to deliver the card to Julia Bates and chant, “Exonerate Now, Clear Danny Brown’s Name!”  They were escorted out of the courthouse under threat of arrest, continuing to chant.  They were joined by those outside, and soon Julia Bates, under armed escort made her way to cocktails and lunch at a nearby drinking establishment.  The crowd followed her there and protested outside chanting.  Some of the favorite chants were: “Cocktails for Julia, Justice for Danny” and “Serve Justice, Not Cocktails.”  Ms. Bates was protected by a half-dozen or so sheriffs inside the restaurant and another half-dozen or so sheriffs and Toledo police outside. She reportedly was able to stomach lunch and a couple of cocktails with approximately the same ease as she has stomached injustice for Danny Brown for many years.

Below is the script of the retirement party mock award that occurred outside the courthouse:

MOCK AWARD

HABEAS B. CORPSE: Hi, my name is Habeas B. Corpse.  I am the president and founder of the National Association for the Advancement of County Persecutors.  The National Association for the Advancement of County Persecutors is proud to present the 2012 Habeas Corpus Award to Lucas County Persecutor Julia Bates.

The Habeas Corpus Award recognizes outlandish success in furthering the principle of speedy justice of the criminal variety.  Lucas County Persecutor Julia Bates has managed to parlay a wrongful conviction of Danny Brown for murder and rape in 1982 into an open-ended, indefinite murder case. Although Danny Brown served 19 years in prison for a crime he did not commit, Lucas County Persecutor Julia Bates was unfazed by such an obstacle to her success. By perpetually holding another suspicious criminal investigation over Danny Brown’s head, Lucas County Persecutor Julia Bates has successfully avoided letting an innocent man clear his name. Lucas County Persecutor Julia Bates has devoted the last decade to producing no evidence worthy of bringing any charges against Danny Brown.  Lucas County Persecutor Julia Bates has demonstrated fantastical creativity in avoiding any exoneration or apology to Danny Brown for his 19 years in prison for a crime he did not commit.  Perhaps, most significantly, if Danny Brown is ever allowed to clear his name, under Ohio law, he would be eligible for compensation for his wrongful conviction resulting in 19 years in prison. This compensation could total over $900,000.  Lucas County Persecutor Julia Bates has successfully postponed this indefinitely.  She has saved Lucas County taxpayers money by devoting virtually no resources to her shallow criminal investigation and by avoiding spending any resources to allow Danny Brown to have his day in court. Please note that Danny Brown is also currently suspected of being innocent of over 666 murders in Lucas County since 1982. With her unending patience in persecuting an innocent Toledo citizen, Lucas County Persecutor Julia Bates has brought new meaning to the term “criminal” justice.

As part of the Habeas Corpus Award, the National Association for the Advancement of County Persecutors provides an honorarium of $30,000.

With equal speed and due diligence the National Association for the Advancement of County Persecutors realized that this 2012 Habeas Corpus Award to Lucas County Persecutor Julia Bates is actually the product of 30 years of wrongful conviction, wrongful imprisonment, and open-ended, unmerited criminal investigations. Yes, we just figured this out. Thus, the National Association for the Advancement of County Persecutors has determined that Lucas County Persecutor Julia Bates is entitled to the Habeas Corpus Award, not only for 2012, but for 31 years:

2011, 2010, 2009, 2008, 2007, ………………….1982

[foldout 28.4 foot certificate accordion-style for each year and have persons line up holding them].

We are awarding the Habeas Corpus Award retroactively for 31 years.  Only now do we truly realize what “speedy” justice is. Since the Habeas Corpus Award comes with an honorarium of $30,000 each year, this makes Lucas County Persecutor Julia Bates’ honorarium a total of $930,000. The National Association for the Advancement of County Persecutors promises to pay this honorarium with the same speed and due diligence that Lucas County Persecutor Julia Bates has so amply demonstrated.

[delivery person rushes in, holding up “RUSH DELIVERY” envelope as delivering it]

[Habeas B. Corpse opens envelope, holds up BREAKING NEWS BULLETIN for crowd to see]

HABEAS B. CORPSE: Wait, what is this? It looks like a breaking news bulletin. Lucas County Persecutor Julia Bates, at this very moment, is filing for moral bankruptcy.  Well, we will just have to trust her good judgment on this one. I’m sure she has an airtight case.

[enter citizen]

Hold on, we are not done here! I am here on behalf of Lucas County citizen’s and in the good name of Danny Brown, to conduct a citizen’s arrest. I demand the arrest of Lucas County Persecutor Julia Bates. She is wanted for murder, the murder of justice for Danny Brown. Warning, Julia Bates, also goes under the aliases of “Julia Will Fool Ya” and “Bates and Switch”. She is armed with a public office and is considered a threat to justice. Her last known whereabouts are reported to be lurking about the county courthouse. We ask that any good, justice-loving citizen of Lucas County arrest her immediately upon determining the whereabouts of this fugitive. I have here “Wanted Posters” to help you identify her, apprehend her, and bring her to justice. And please hurry, rumor has it that the best practices in such matters is to wrap up such matters within 30 years, give or take a decade or so.

[handout wanted posters]

Mock Funeral – Occupy Toledo

Yesterday, April 1st, April Fool’s Day, was the one and only performance of Occupy Toledo‘s Mock Funeral — in life (and death) there are no rehearsals, this is it!  If you missed it, I truly hope that you were doing something else as fun and inspiring!  Thanks to all the players, readers, eulogizers, ushers, HOMElessLAND SECURITY, providers of food, and all who helped make Occupy Toledo’s RE-BIRTHDAY possible.  We rose like a phoenix from the ashes!!  Occupy Toledo will re-start the physical re-occupation of Toledo on May1, May Day, the day of a worldwide general strike!  Join us May 1 in Levi’s Square, downtown Toledo, St. Clair at Madison.  In the meantime you can come help plan the occupation of Toledo at our General Assembly meeting every Wednesday at 6:30 pm at Third Space.

Below is a picture of our own Rev. Ed Heilman serving as mock preacher (note the dollar sign on his bishop’s hat and the dollar sign cross on the altar)

Mock Funeral Preacher (Rev. Ed Heilman)Here is Occupy Toledo’s Obituary from the Mock Funeral:

“Occupy Toledo was born October 10, 2011, to it’s parents, the Arab Spring and Occupy Wall Street. Born of hope, Occupy Toledo burst onto the scene in its own charmingly childish way. However, from the birth of Occupy Toledo, few people could understand what it wanted. Onlookers mumbled again and again: “What do they want?” “I don’t get it.” Occupy Toledo flailed around for about 6 months until it realized that it was too small to succeed. After scrutinizing corporate behavior, Occupy Toledo in due course discovered that the nobility of American corporations was unparalleled. The dearly departed realized that in these great United States of America, injustices are so few and far between, that it could no longer even occupy itself. Unavoidably, Occupy Toledo came to its senses, recognized its irrelevancy, and accepted that resistance to corporate rule is futile. Fortunately, in the end, Occupy Toledo had gained at least the good sense to crawl into a coroner’s office and die. Occupy Toledo died on April 1, 2012, due to apathy. Protesters were the Time Magazine Person of the Year in 2011. Gracefully, protesters like Occupy Toledo are stepping aside to make room for the inevitable Time Magazine Person of the Year for 2012: the Corporate Person, born of Citizens United, the true will of human persons across America. Occupy Toledo is survived by countless cousins around the country, many of whom have not achieved enlightenment, so they have not yet abandoned their vain struggles against corporate America, which is obviously too big too fail. The bad news is that Occupy Toledo is dead. The good news is that its condition is stable.”

Below is a picture of our own local activist doctor, Johnathon Ross, M.D., reading Occupy Toledo’s Death Certificate and pronouncing its death.

Mock Funeral Doctor (Johnathon Ross, M.D.)Here is Occupy Toledo’s Death Certificate from yesterday’s Mock Funeral:

“I hereby certify that Occupy Toledo, born October 10, 2011, has died on this day, April 1, 2012. The immediate cause of death was apathy. The underlying causes of death included: 1) an atrophied brain due to an overexposure to TV news and infotainment, talk radio, and so-called “reality” TV; 2) learned helplessness, due to an enlarged gullibility, making it susceptible to corporate propaganda and so-called political pundits; 3) a weakened constitution due to lack of exercising freedoms and widespread metastases of planetary consumption; and lastly, 4) pure exhaustion from running on the treadmills of trying to earn enough to maintain a decent household and fend off crushing debt.”

Of course, after the 1% overstepped their hand with their crass compulsions (by bidding on the Phoenix egg for their breakfast), the Phoenix’s prophecy was fulfilled:

“Hear this prophecy: The crass compulsion of the few to buy anything and everything is complete. The few dare to literally buy and consume the HOPE of the many. Because of this abomination of the few, the Phoenix’s prophecy is complete. The many, the 99%, Occupy Toledo, will be re-born one month from today in this same place. HAPPY RE-BIRTHDAY OCCUPY TOLEDO. Join us on May 1, May Day, a world-wide general strike, for the re-occupation of Toledo. Thus speaks the Phoenix, ‘You, the many, the 99%, shall arise again and be free. Join together with the peoples of this land and from around the world, and the few, the 1%, will be vanquished.’ “

Below pictured is yours truly, Dan Rutt, alias “Top Pun” (it’s just, my pun name), with the HAPPY RE-BIRTHDAY card placed over the tombstone announcing the re-occupation of Toledo.

POEM: Protesting Pet Peeves

I would protest against my pet peeves
Except, I’m not sure that “Honk if you want to end noise pollution”
Would work out so well

I like this funny little poem because it teases at the natural limits of something like protesting.  Many people consider me a big-time protesters.  Perhaps fewer people recognize that noise pollution is one of my major pet peeves.  I love the sign that protesters have that say “Honk for peace” or the like.  This is a great way to invite others to get involved in making a public statement about something very important.  However, when you put these two things together: a honky protest and a desire to end noise pollution, the incongruity becomes comical.  Life is funny!  Thank God!  Sometimes we just have to live into the mystery and find things laugh-worthy along the way, especially when dealing with serious or difficult issues.  At some moments in life, it may not be possible to have both peace and quiet; it may be a choice of peace or quiet.

Corporate Tax Dodger FirstEnergy, Toledo Protest

The corporate tax dodger FirstEnergy paid no income taxes on its over $1.2 billion of profits in 2010.  FirstEnergy provides electricity to Toledo and the surrounding area.  At noon today, about two dozen protesters gathered outside the corporate headquarters of FirstEnergy in downtown Toledo.  The protesters gathered to demand that FirstEnergy pay its fair share of taxes, which would definitely be more than zero!  The protest was organized by Fight for a Fair Economy which organize similar protests around Ohio to protest Ohio energy companies making billions of dollars in profits and paying no income taxes.  The Fight for a Fair Economy (Ohio) is a collaboration of efforts between the SEIU union, labor allies, community partners and grassroots supporters to fight back against attacks on working people and their families all across Ohio.  Other local groups which participated were Occupy Toledo and Jobs with Justice Toledo.  Pictured below is Top Pun holding up a bright yellow sign that says “FirstEnergy is a tax dodger, pay your fair share.”  The sign to the far left says, “Why is it easier to believe that 150 million Americans are lazy rather than 400 Americans are greedy.”  The sign indicating Interfaith Worker Justice is a reference to one of the partner coalitions of Jobs with Justice Toledo.

First Energy Corporate Tax Dodgers Toledo Protest

Please visit Ohio Citizens Action to see a list of 37 Ohio corporations who paid no income taxes.  These 37 Ohio corporations made over $50 billion in profits and actually made another $7.8 billion in tax credits, for an effective tax rate of -15.6%.  Each of these companies are profitable without taxpayer support.  Each of these companies benefits from taxpayer supported infrastructure and services.  We should end this corporate welfare and demand that these companies make a fair contribution to their communities and no longer be a drain on our tax dollars, especially during a very difficult time for our economy and when essential government services are being strained or cut.

American Spring Coming: Occupy G8 and NATO in Chicago

With the G8 and NATO summits coming to Chicago in the middle of May, the occupy movement is poised to jump start the American Spring.  The Occupy Wall Street movement has already called for a general strike on May Day, May 1.  This is a call for No Work, No School, No Housework, No Shopping, No Banking,  TAKE THE STREETS!  My own local occupy, Occupy Toledo, is planning to retake a public place with a long-term occupation on May Day.  With continued dissatisfaction with economic conditions, better weather on the horizon, and the convergence of large-scale occupations, this May could very well be the American spring.
“Against the backdrop of a global uprising that is simmering in dozens of countries and thousands of cities and towns, the G8 and NATO will hold a rare simultaneous summit in Chicago this May. The world’s military and political elites, heads of state, 7,500 officials from 80 nations, and more than 2,500 journalists will be there.
And so will we.

…The political establishment in Chicago has been particularly brash in its treatment of the movement. Occupy Chicago is one of the few to never succeed in maintaining an encampment, as two attempts were met with over 300 arrests in the city’s famed Grant Park last fall. While clearly intended to deflate the movement’s momentum ahead of the coming summits in May, this political repression only served to place the plight of Occupy in the limelight. Not content with cracking down on the Occupy camps, the mayor then escalated his assault by introducing a whole new set of rules for protests. Just prior to the holiday recess in December, he proposed changes to the two city ordinances dealing with demonstrations and parades, including increased fines for offenses to draconian new filing requirements for parade organizers.

…The American Spring will not materialize out of resentment from just a few isolated incidents of political repression. Like its Arab-world counterpart, it will be the product of a population that has reached its breaking point after years of systemic abuse. The fact is that the assault on basic civil liberties in this country has been so widespread that focusing on a handful of examples risks trivializing the issue. From the Patriot Act and FISA to NDAA to the president’s newfound right to assassinate, the federal government has acted with marked impunity from Bush to Obama. Meanwhile, the state and local level governments maintain the bulk of the world’s largest system of incarceration, still rooted in age-old prejudices and sociological biases. In many ways, Occupy is reflective of an awakening generation: the babies of the baby-boomers who no longer buy the petty propaganda spoon-fed in school about this nation being a “beacon of peace.”

…Another important factor informing a possible American Spring is the promulgation of hysteria by the political, economic and media elite. As with the enactment of repressive policies, hysteria is designed to drive fear into the masses in order to dissuade them from protest. It is also an indication of a ruling elite that has become increasingly desperate and a political class that is rapidly losing its moral authority. As people begin to recognize this, they may be less inclined to trust the vilification of protesters as “destructive and dangerous anarchists,” and may be more likely to identify with them.

…Another compelling sign of a coming American Spring is the inspiring level of political organization present in Chicago. On the one hand, there is the “Coalition Against the NATO G8 War and Poverty Agenda” (CANG8), which has been planning the massive demonstration on May 19th since the summits were announced. They also organized much of the resistance to the city’s new anti-protester ordinance, including a picket at City Hall on the day of the vote. In that latter effort, they were joined by dozens of supporters of Occupy Chicago in what culminated a strong joint effort among protest groups throughout the city. Organizer Andy Thayer told me: “The battle over the ordinance really brought together these various movements. I think the city was really taken aback by the response.” He further said that he was expecting to see the same few regular faces at the work-time picket at City Hall, only to find that Occupy had substantially energized their efforts.

…While the power elite make their destructive plans inside, the American people will be constructing a better world on the outside.
I hope that you will join me and the thousands and thousands of people from across the United States and from around the planet that will be giving the peoples’ message about making our world a better place for all of us to live.

Violence Protects the State

Stephanie N. Van Hook, Executive Director of Metta Center for Nonviolence in Petaluma, California, has written a commentary in Znet on How Violence Protects the State.  Here is an excerpt:

“Violence in opposition to the State relieves the State and the citizenry of any guilt for a brutal response to all protesters—and it refocuses from the nominal issue to the issue of violence by protesters. Thus any violence by protesters serves the state well (just ask anyone employed by the government who has hired an agent provocateur). It is a weapon of mass distraction. Stop worrying about the uptick in home foreclosures, the dead being shipped back from Afghanistan, and the new increases in the Pentagon’s proposed budget—look at the violent window-breakers from Occupy who threaten us all!

…Nonviolence is not just protest, it is not simply occupying space and it is not just about adversarial confrontations; it’s about our humanity…

In short, in order to delegitimize a violent system, we have to delegitimize violence. This change requires us to adopt a principle about human beings and human dignity: we will not use violence against others because we want to create a vibrant culture, a merciful culture, a generous culture because we as human beings have the potential to nurture these qualities within ourselves and each other. We will not degrade human dignity because it is not worthy of ourselves as people; let this be the motivation for our long-term struggle. The power of the violent State system would stand much less chance against a movement committed to this nonviolent, compassionate spirit of unity.”

The debate between violence and nonviolence is age-old.  Though, nonviolence has sort of come of age in the modern period, particularly with history proving nonviolence’s effectiveness in domestic regime change.  The current relevance of this topic is related largely to the occupy movement captures a lot of popular unrest with our own domestic regime.  With great injustices, anger is a natural and healthy response.  Unfortunately, violence is not a natural and healthy response to anger.  We need to channel the energy of our anger and rage against injustice into ways of living that will actually result in a new and better way of living together as humanity.  I believe that nonviolence represents that way of living.  If you want something different from violence we are going to have to do something different and violence.  Violence begets violence.  Love begets love.  Respect begets respect.  You get the picture.  It seems that lectures on means and ends have become a common theme in my life and in my blogs recently.  I love the logic of the means producing the ends.  I just wish this approach got more respect. I guess that when it comes to violence, it is very hard to overcome old habits and venture into territory that presents a lots of personal uncertainty and risk (by disarming).  While controlling others through propaganda, terror and violence, seems to be able to go a long way, controlling others ultimately short-circuits our ability to live in peace and harmony with one another.  I believe it is worth a lot of risk to make living in peace and harmony possible.  Let’s not allow the state to divide us through violence, either its own, or through provoking violence in us.

Black Bloc Anarchists Play into Hands of State Control

Chris Hedges of Znet reports on the The Cancer in Occupy as the Black Bloc Anarchists who typically are the small number in the Occupy movement protesters who behave violently, attacking police, and destroying property.  While the Occupy movement as a whole is overwhelmingly committed to nonviolence, the use of violence that occurs occasionally plays neatly into the hands of statist forces.  Acts of violence invariably capture the focus of the media and reinforces negative stereotypes of many Americans who have concerns with the Occupy movement.  Most importantly, the State knows how to deal with violence.  It is better equipped for violence.  It is better trained for violence.  Police and military forces vastly outnumber violent protesters.  All Weapons Are Boomerangs-PEACE BUTTONThis is a losing formula.  Personally, as a pacifist, I find violence intrinsically offensive. However, in this case, it seems that using violence is clearly a losing formula from purely a tactical point of view.  Violence creates great confusion in the minds of onlookers, regarding what is the cause and who is responsible.  Also, the vast majority of Americans would presume that the police typically have some legitimate reason for using force when confronted with violence.  A key part of the power of nonviolence is in exposing the injustice and dis-proportionality of violence, particularly state violence in terms of police or military action.  By not confusing who is perpetuating the violence, onlookers can clearly attribute where the violence is coming from, and when unjust or disproportional, the perpetrators of violence lose legitimacy and the consent of the governed atrophies.  This greatly aids revolution and evolution.

No War in Iran – Toledo and Defiance Protests

Top Pun at Toledo "No War in Iran" Protest

Top Pun at Toledo "No War in Iran" Protest

This last weekend I participated in two protests as part of the national Day of Mass Action to Stop War on Iran – February 4, 2012.  On Saturday afternoon, about 15 to 20 people gathered outside the Defiance County Courthouse in Defiance, Ohio.  This anti-war protest was sponsored by the Defiance County Citizens for Change and Occupy Defiance.  It was certainly difficult for me to resist participating in an act of defiance of war in a city literally named Defiance! On Sunday afternoon, about 30-some protesters gathered at the corner of Secor Road and Central Avenue.  This no war in Iran protest was a special edition of the Northwest Ohio Peace Coalition’s weekly protests against war has been going on since the beginning of the Iraq war in 2003.  A call to action and endorsement by Occupy Toledo helped bolster the usual numbers of the unusual suspects.

Both days were beautiful February days thanks to global climate change.  In an unrelated observations, there were large numbers of internal combustion vehicles passing by at both locations.  There was an overwhelming friendliness to our antiwar message, maintaining a very positive ratio of at least 10 to 1 of honks for peace versus middle fingers and angry screams out of the window.  Of course, there were plenty of blank stares and averted gazes amongst the silent majority.  Hopefully, those people who were not even looking outside the car window, busily texting, were telling their friends and enemies to come down and join the protest.  I would note that this is a big change from the beginning of the Iraq war in 2003 when the NWOPC weekly protests began.  At that time, with the run-up to the Iraq war and the shock and awe beginning of the so-called war, the American people seemed patriotically supportive or oblivious to our wars and their implications.  At these weekly protests, at the beginning of the Iraq war, there were a large number of motorists hurling angry epitaphs at us for protesting the war.

You Can No More Win a War Than You Can Win an EarthquakeA few days before the Iraq war started, a couple dozen or so of us were arrested protesting in front of the Toledo U.S. Army recruitment center.  Eight or nine of us went on trial a few weeks later, and during jury selection I was amazed to witness that the majority of jurors could not even state an opinion regarding the war.  Obviously, most Toledoans, probably fairly representative of Americans, were either not paying attention and/or didn’t really care.  I hope that today, after a decade of drumming up and fighting what is openly billed as an endless war against terrorism, that the American people are beginning to realize that the so-called new war against terrorism is really just the same old war that has been fought since the beginning of humankind, or human unkind as the case may be!  One of my favorite quotes shown in the peace sign design to the right, demonstrates the futility of war: “You can no more win a war than win an earthquake!” May we truly take this to heart and not fight merely to end a particular war but to end war itself.
